Asylum and the Law
U.S. immigration law provides asylum status for foreign nationals who have suffered persecution in the past and fear they will be persecuted if they return to their home countries.
These types of persecution may qualify a person for asylum status:
- Persecution because of race
- Persecution because of religion
- Persecution because of nationality
- Persecution because of ethnicity
- Persecution because of membership in a social group
Victims of domestic violence and human trafficking may be able to obtain temporary visas under the Violence Against Women Act (VAWA) and the Victims of Trafficking and Violence Protection Act (VTVPA).
Overcoming Challenges in Asylum Cases
The asylum seeker must demonstrate that he or she has suffered persecution in the past and will again upon return to the home country. The evidence supporting the asylum seeker's application may be out of reach and therefore, his or her immigration status may be compromised. Even if visible manifestations of persecution do not exist however, it may still be possible to achieve asylum status.
